TRAIAL takes your privacy seriously. TRAIAL is committed to process any personal information we collect (hereafter generally referred to as information) in full transparency, in accordance with applicable laws and regulations, so as to ensure the accuracy, confidentiality and security of your information.

This privacy notice applies to the information TRAIAL collect from you as a user or legal specialist accessing and using our Services.

This privacy notice is dated 19.03.2019. It may be updated from time to time, in which case you shall be notified of any such modification.

1. What is personal information?

Personal information is any information that can enable the identification of an individual. Information may, as such, enable your identification (like your first and last names, email address or social security number), or may enable such identification and provide information when combined with one another (such as your computer's Internet Protocol (IP) address, operating system and browser type).

2. What information does TRAIAL collect from you?

Information that TRAIAL collect with regards to your access and use of our Services typically consist of the following information, expressly provided through your account creation:

As users (fields mentioned with an asterisk are mandatory, while additional ones are optional, at users discretion):

  • *Corporate name of the entity you represent (if the account is opened for such company)
  • *Your date of birth
  • Your address, respectively the registered seat of the company if the account is opened for such company)
  • *Your email address
  • *Your phone number
  • *Your credit card details
  • Your picture
  • Any information you exchange with us by email.

As provider (all fields are mandatory):

  • Your name
  • Your last name
  • Corporate name of the entity you represent (if the account is opened for such company)
  • Your date of birth
  • Languages that you speak and can work in
  • Your address (respectively the registered seat of the company if the account is opened for such company)
  • Your email address
  • Your phone number, including your cell phone number
  • A copy of your academic and relevant professional title (s) and current employer (if any)
  • Date of your bachelor degree
  • Date of your bar exam (if applicable)
  • Curriculum vitae
  • Fields of expertise and/or predilection
  • Bank account details
  • Any information you exchange with us by email.

You shall also be entitled to provide additional optional information at your discretion in your profile, such as a picture.

3. Why does TRAIAL collect such information?

Such information may be collected to achieve one of the following purposes, each of which is either required to perform the Services or is the result of a legitimate interest for TRAIAL to process such information in your contractual relation with TRAIAL:

As users:

  • Your first and last name as well as, if applicable, corporate name of the entity you represent, to enable the account creation and enable you to benefit from access and use of our Services, as well as to enable potential providers to assess any conflict of interests;
  • Your phone number, so as to enable us to notify you of any development in the processing of your question;
  • Your date of birth to enable us to ensure that you are of legal age in your country of residence;
  • Your address, respectively the registered seat of the company if the account is opened for such company) to ensure that the identity disclosed through your account creation is not fictive and reflects your true identity;
  • Your email address to enable us to get in touch with you with regards to our Services;
  • Your credit card details to enable payment processing through the use of our Services.

As providers:

  • Your first and last name as well as, if applicable, corporate name of the entity you represent, to enable the account creation and enable you to your legal support to users;
  • Your date of birth to enable us to ensure that you are of legal age in your country of residence;
  • The foreign language(s) that you speak to optimize contacts with specific users’ needs
  • Your address, respectively the registered seat of the company if the account is opened for such company) to ensure that the identity disclosed through your account creation is not fictive and reflects your true identity;
  • Your email address to enable us to get in touch with you with regards to our Services, notably so as to inform you of any request in your field of expertise and your appointment by users to respond to their requests;
  • Your phone number for the same purpose as set out under litera (e) above as well as to enable us to get in touch with you, which we shall only do when deemed necessary with regards to our Services only;
  • Professional title and current employer (if any), dates of your bachelor degree and bar exam (if applicable) to enable us and users to assess that you have the required qualifications and credentials;
  • Curriculum vitae, which may contain further personal information, as you agree to disclose in such curriculum vitae that will be disclosed to users whose requests you have accepted;
  • Bank account details to enable us as your agent to proceed with the payment of your remuneration by users.

Any non personal identifiable information, including aggregated or anonymized information, may be used to administer the Services, improve customer service, diagnose problems with our servers, track user movement, and gather demographic information for aggregate use.

4. Who might TRAIAL share your information with?

TRAIAL may disclose and share some of your information with the following entities:

  • Any third party to which we are ordered to disclose such information as a result of a Court order, governmental authority and/or by law;
  • Any third party whose involvement is required to enable performance of your contract (such as payment processors);
  • Any third party we may interact with to perform one of the purposes identified above;
  • As users, any personal information you may disclose at your own will in your question will be shared with the legal specialists that may be interested in answering such question, which is the reason why TRAIAL strongly recommends you not to disclose any such personal information;
  • As users, your name and first name so as to enable potential providers to assess any conflict of interests;
  • As providers, (i) your first and last names, (ii) curriculum vitae and related information such as date of your professional title, date of your bachelor degree and bar exam (if applicable) to users so as to enable them to select you to respond to the requests you have accepted;
  • as part of any merger, acquisition, debt financing, sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which your information could be transferred to third parties as one of TRAIAL’s business assets. In such an event, we will attempt to notify you before your information is transferred, but you may not have the right to opt out of any such transfer

5. Where will my information be stored?

Information collected by TRAIAL is stored and processed through AWS in Ireland, a country considered by the Swiss and European Union relevant authorities as having an adequate level of protection with regards to data protection.

6. How does TRAIAL protect my information?

TRAIAL is committed to protecting the security of your personal information so as to prevent it from unauthorized access, use, modification or disclosure. To that effect, TRAIAL has decided to work with one of the major and most secured player in this field, namely AWS, whose security credentials can be found out here https://aws.amazon.com/security.

TRAIAL further contractually ensures that any third party (as described above) equally processed your personal information in a secured way to ensure its confidentiality and integrity.

Please however bear in mind that no security measures are perfect or impenetrable. To protect the confidentiality of your information, you must keep your password confidential and not disclose it to any other person. You are responsible for all use of the Services by any person using your password. Please advise us immediately by emailing us if you believe your password has been misused.

7. How long does TRAIAL retain your information?

TRAIAL retains your personal information only for as long as it believes is necessary to fulfill the purposes for which the personal information was collected, usually for the duration of your account and affiliation to TRAIAL and for any period thereafter as legally required or permitted by applicable law (including, for the purpose of meeting any legal, accounting or other reporting and regulatory requirements or obligations).

Any further personal information disclosed through your requests, which we strongly discourage, will be removed from the platform once responded and archived for any period thereafter as legally required or permitted by applicable law (including, for the purpose of meeting any legal, accounting or other reporting and regulatory requirements or obligations).

TRAIAL may, instead of destroying or erasing your personal information, make it anonymous such that it cannot be associated with or tracked back to you.
